Have helped a number of solicitors' firms with issues relating to their employees. There have been redundancies in a property firm, which we have handled sensitively and efficiently. Maternity bonus issues have arisen in a specialist practice, with the potential for a sex discrimination claim if not approached carefully. We have advised on protecting the business when solicitors leave, threatening to take clients with them. The new pension regime that is being rolled out across businesses has been explained. Advice has also been given on staff policies and suitable contracts with provisions protecting the business (in terms of confidentiality and when staff leave) to a firm carrying out publicly funded housing work. We support a newly formed and very successful trade union, providing help on complex employment issues to the officials. These have included difficult unfair dismissal claims, unlawful deduction of wages, race discrimination, rehousing (as part of a deal on the member leaving his job) and help in settlement negotiations generally. We have successfully dealt with a complex collective redundancy, spanning many months and involving over 25 being made redundant. We had to set up elections for representatives and advise on that procedure. There was then both collective and individual consultation. We drafted all the necessary paperwork and easy to understand information for each step of the process for management. This way we broke down a complicated procedure into manageable steps. At each stage we gave dos and don'ts so that everyone was clear on how to manage the process properly. As it all took a long time, it was important to keep morale up, to minimise the risk of disruption to the business and claims. This we achieved.

Acted for Doctor's surgery on a gross misconduct disciplinary involving the theft of monies from the surgery over a two year period. Advised on the investigation, disciplinary and the gross misconduct termination.
Acted for Respondent (luxury hotel) in Employment Tribunal who dismissed Claimant on performance grounds. Case successfully settled for minimal amount. We had applied for the case to be struck out and for a Pre Hearing Review to be heard. Claimant was looking for at least 20 x the amount in damages.
